The uncertainty around the bidding in the real estate is big nowadays. There is no clarity in the law and much has been formed in practice. The real estate agent sits on all the information and with it still represent both the seller and the buyer. The law has been changed and developed through the introduction of new paragraphs. Despite this, the reports of bidding to FMI is increasing each year. It’s said that it’s the seller that controls the deal and the real estate agent gives advice. The seller has “free trial” and makes the decisions. A bid is not binding which means that you can bid without really having the money. To increase the trust against the clients they changed the law in 2011 which means that the real estate agent must provide an offer list. The thought was to increase the transparency and put confidence in the clients. The question is if this has helped or not. If the real estate agent informs and gives the right directive, customers have confidence in the agent. Without communication there is no confidence. Much responsibility remains on the agent when there is no regulation in law. To develop and improve requires stricter legislation and clearer design.
